Jack Smith Gets In Judge’s Face — Issues Direct Threat If He Doesn’t Get His Way

In a scathing new filing, Special Counsel Jack Smith took aim at Judge Aileen Cannon, who was chosen by Trump, for her decision to request jury instructions that included the former president’s “erroneous” defense legal theory.

Critics of the judge claim she is dragging out the case to help the man who appointed her. Smith and his staff have been at differences with Cannon over a number of issues.

Smith responded to Cannon’s order to submit draft jury instructions that take into account “competing scenarios and offer alternative draft text that assumes each scenario to be a correct formulation of the law to be issued to the jury”—scenarios Smith claims are fatally flawed. This frustration was clearly visible in Smith’s response.

Smith undermines the judge’s ruling in the first few words of his reply, threatening “appellate action” if she proceeds in this manner:
